Resolving a dispute regarding the illegal use of a trademark

The official representative of a well-known Turkish company in Azerbaijan, which manufactures Alkopan construction products, has applied to our Company for legal assistance in preventing the illegal use of their brand.

It was explained that the act committed against persons engaged in the sale of counterfeit products constitutes liability under Article 197 of the Criminal Code. Realizing the seriousness of the liability, those persons asked not to file a complaint with the law enforcement agencies. The negotiations yielded results and, in the end, a notarized undertaking was obtained from the persons in question not to import or sell the Alcopan construction product under the mentioned brand name into the territory of Azerbaijan.
